VELHO<\/strong><br \/>\n<strong>COMISS\u00c3O PERMANENTE DE LICITA\u00c7\u00d5ES<\/strong><\/p>\n<hr \/>\n<p><strong>DECRETO N\u00ba 134, DE 30 DE JULHO DE 2021.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Regulamenta os m\u00e9todos de avalia\u00e7\u00e3o<\/strong> <strong>da propriedade de im\u00f3veis situados na zona rural, urbana e de expans\u00e3o urbana do Munic\u00edpio de Pedro Velho e d\u00e1 outras provid\u00eancias.<\/strong><\/p>\n<p><strong>A PREFEITA MUNICIPAL DE PEDRO VELHO, dentro das suas a atribui\u00e7\u00f5es legais e<\/strong>,<\/p>\n<p><strong>Considerando a <u>Lei n<sup>o<\/sup> 278\/1997, publicado em 23 de dezembro<\/u>, considerando os artigos 8\u00ba, 9\u00aa, 10\u00ba que regulamenta os m\u00e9todos de avalia\u00e7\u00e3o da propriedade de m\u00f3veis situados na zona rural e urbana e de expans\u00e3o urbana do munic\u00edpio de Pedro Velho.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Art. 1\u00ba <\/strong>\u2013 Fica aprovada a regulamenta\u00e7\u00e3o dos m\u00e9todos de avalia\u00e7\u00e3o da propriedade de im\u00f3veis situados na Zona Rural e Zona Urbana e de expans\u00e3o Urbana e de expans\u00e3o urbana do munic\u00edpio dos im\u00f3veis situados na zona rural, urbana e de expans\u00e3o urbana do Munic\u00edpio de Pedro Velho.<\/p>\n<p><strong>Art. 2\u00ba <\/strong>\u2013 O valor venal dos im\u00f3veis rurais ser\u00e1 obtido pela soma dos valores venal de terra nua e das benfeitorias se houver, de conformidade com as normas e m\u00e9todos ora fixados.<\/p>\n<p><strong>Art. 3\u00ba <\/strong>\u2013 O valor venal dos im\u00f3veis urbanos ser\u00e1 obtido pela soma dos valores venal do terreno e da constru\u00e7\u00e3o se houver, de conformidade com as normas e m\u00e9todos ora fixados.<\/p>\n<p><strong>Art. 4\u00ba <\/strong>\u2013 O valor venal dos im\u00f3veis ser\u00e1 determinado em fun\u00e7\u00e3o dos seguintes elementos, tomados em conjunto ou separadamente:<\/p>\n<p><strong>I <\/strong>\u2013 pre\u00e7o corrente das transa\u00e7\u00f5es e das ofertas \u00e0 venda no mercado imobili\u00e1rio;<\/p>\n<ul>\n<li>\u2013 Zoneamento urbano ou rural;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>\u2013 Caracter\u00edsticas do logradouro, ou face de quadra onde se situa o im\u00f3vel;<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>IV <\/strong>\u2013 caracter\u00edsticas do terreno, como:<\/p>\n<ol>\n<li>\u00e1rea;<\/li>\n<li>topografia, forma, acessibilidade, consist\u00eancia do solo e situa\u00e7\u00e3o no lote e na quadra e outras caracter\u00edsticas que venham a influenciar no valor do terreno.<\/li>\n<\/ol>\n<p><strong>V <\/strong>\u2013 caracter\u00edsticas da constru\u00e7\u00e3o, tais como:<\/p>\n<ol>\n<li>\u00e1rea;<\/li>\n<li>qualidade, tipo e ocupa\u00e7\u00e3o;<\/li>\n<li>o ano da constru\u00e7\u00e3o ou de seu cadastro e sua conserva\u00e7\u00e3o e outras caracter\u00edsticas que venham a influenciar no valor da constru\u00e7\u00e3o.<\/li>\n<\/ol>\n<p><strong>VI <\/strong>\u2013 custo de reprodu\u00e7\u00e3o da constru\u00e7\u00e3o.<\/p>\n<p><strong>DA AVALIA\u00c7\u00c3O DOS TERRENOS RURAIS<\/strong><\/p>\n<p><strong>Art. 5\u00ba <\/strong>\u2013 O valor venal do terreno rural corresponder\u00e1 ao resultado da multiplica\u00e7\u00e3o de sua \u00e1rea pelo valor unit\u00e1rio do hectare, constante em c\u00f3digo por localidade, distrito ou bairro, conforme previsto na Tabela I, aplicado, simultaneamente, os fatores de corre\u00e7\u00e3o previstos nas Tabelas XII a XVI, deste decreto.<\/p>\n<p><strong>Par\u00e1grafo \u00fanico <\/strong>\u2013 N\u00e3o constando especifica\u00e7\u00e3o do distrito ou bairro em que se situa o im\u00f3vel rural, este ter\u00e1 seu valor arbitrado, tomando-se por base o distrito ou o bairro mais pr\u00f3ximo que conste na Tabela I anexa, ou por outros indicativos de valor ou informa\u00e7\u00f5es obtidas pela Secretaria Municipal de Tributa\u00e7\u00e3o e Planejamento.<\/p>\n<p><strong>DA AVALIA\u00c7\u00c3O DOS TERRENOS URBANOS<\/strong><\/p>\n<p><strong>Art. 6\u00ba <\/strong>&#8211; O valor venal dos terrenos urbanos corresponder\u00e1 ao resultado da multiplica\u00e7\u00e3o de sua \u00e1rea pelo valor unit\u00e1rio do metro quadrado, constante em c\u00f3digo por face de quadras dos Valores de im\u00f3veis, conforme Tabela II, aplicado, simultaneamente, os fatores de corre\u00e7\u00e3o previstos nas Tabelas V a XI, desta Lei.<\/p>\n<p><strong>Par\u00e1grafo \u00fanico <\/strong>&#8211; No caso de lotes de uma ou mais esquinas e de lotes com duas ou mais frentes ser\u00e1 adotado o valor unit\u00e1rio de metro quadrado de terreno nas seguintes condi\u00e7\u00f5es:<\/p>\n<p><strong>I <\/strong>&#8211; quando se tratar de im\u00f3vel constru\u00eddo, a do logradouro relativo \u00e0 sua frente ou, havendo mais de uma, a principal;<\/p>\n<ul>\n<li><strong>&#8211;<\/strong> quando se tratar de im\u00f3vel n\u00e3o constru\u00eddo, o do logradouro relativo \u00e0 frente indicado no t\u00edtulo de propriedade ou na sua falta, ao logradouro de maior valor.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art. 7\u00ba <\/strong>&#8211; No c\u00e1lculo do valor venal do lote encravado ou de fundos, ser\u00e1 adotado o valor unit\u00e1rio de metro quadrado de terreno correspondente ao logradouro de acesso, aplicado o fator de corre\u00e7\u00e3o previsto na Tabela IV, anexa a este decreto.<\/p>\n<ul>\n<li><strong>1\u00ba <\/strong>&#8211; Considera-se lote encravado, ou de fundos, o que possuir como acesso, unicamente, passagens de pedestres com largura inferior a 2,00 metros.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li><strong>2\u00ba <\/strong>&#8211; Havendo mais de um logradouro de acesso, prevalecer\u00e1, pare efeitos deste artigo, aquele que possuir o maior valor unit\u00e1rio<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art. 8\u00ba <\/strong>&#8211; O valor unit\u00e1rio em metro quadrado de terreno de que trata a Tabela II ser\u00e1 valorizado em fun\u00e7\u00e3o da quantidade de equipamentos urbanos existentes no logradouro ou trecho de logradouro aplicando-se, para tanto, o fator de valoriza\u00e7\u00e3o estabelecido pela Tabela IV, anexa a este decreto.<\/p>\n<ul>\n<li><strong>1\u00ba <\/strong>&#8211; O fator de valoriza\u00e7\u00e3o de que trata o caput ser\u00e1 obtido pela soma dos coeficientes atribu\u00eddos a cada um dos equipamentos urbanos relacionados na Tabela IV, adicionando-se ao resultado o coeficiente 1,00.<\/li>\n<li><strong>2\u00ba <\/strong>&#8211; Para logradouro ou trechos de logradouro sem equipamentos urbanos ser\u00e1 aplicado o fator de valoriza\u00e7\u00e3o unit\u00e1rio (igual a 1,00).<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art. 9\u00ba <\/strong>&#8211; O Fator Profundidade dos terrenos ser\u00e1 obtido em fun\u00e7\u00e3o de sua profundidade equivalente (Pe), que corresponder\u00e1 ao quociente da \u00e1rea do terreno pela extens\u00e3o de sua testada principal.<\/p>\n<p><strong>Par\u00e1grafo \u00fanico <\/strong>&#8211; Fixa-se em 20,00m (vinte metros) a profundidade equivalente do lote padr\u00e3o do Munic\u00edpio de Pedro Velho.<\/p>\n<p><strong>Art. 10 <\/strong>&#8211; Na determina\u00e7\u00e3o da profundidade equivalente de terrenos situados em esquinas ser\u00e1 considerada:<\/p>\n<p>I &#8211; a testada que corresponder \u00e0 frente principal do im\u00f3vel, quando constru\u00eddo;<\/p>\n<p>II- a testada que corresponder \u00e0 sua frente indicada no t\u00edtulo de propriedade ou, na sua falta, \u00e0 frente que corresponder ao maior valor unit\u00e1rio de terreno, quando n\u00e3o constru\u00eddo.<\/p>\n<p><strong>Art. 11 <\/strong>&#8211; Consideram-se de esquina os lotes em que o prolongamento de seus alinhamentos, quando retos, ou das respectivas tangentes, quando curvos, determine \u00e2ngulo interno inferior a 135\u00ba (cento e trinta e cinco graus) ou superior a 45\u00ba (quarenta e cinco graus).<\/p>\n<p><strong>Art. 12 <\/strong>\u2013 O valor venal das glebas brutas (Vt) ser\u00e1 o produto da multiplica\u00e7\u00e3o entre o valor de metro quadrado para a face de quadra que corresponder ao maior valor unit\u00e1rio de terreno (Vut), a \u00e1rea do terreno (At) e o Coeficiente de gleba (Cg), conforme a equa\u00e7\u00e3o abaixo:<\/p>\n<p>Vt = Vut \u00d7 At \u00d7 Cg.<\/p>\n<ul>\n<li><strong>1\u00ba <\/strong>\u2013 Para efeito deste decreto, considera-se gleba os terrenos urbanos com \u00e1rea total superior a 3000 m\u00b2 (tr\u00eas mil metros quadrados).<\/li>\n<li><strong>2\u00ba <\/strong>&#8211; O Coeficiente de gleba (Cg) ser\u00e1 definido pela seguinte equa\u00e7\u00e3o:<\/li>\n<\/ul>\n<p>Cg = (At)<sup>(-0,20)<\/sup>\u00a0 \u00d7 2,3<\/p>\n<p><strong>Art. 13 <\/strong>&#8211; Os logradouros ou trechos de logradouros que n\u00e3o constam no c\u00e1lculo do valor venal de Valores de im\u00f3veis que integra este decreto, ter\u00e1 seu valor fixado pelo Auditor e\/ou o Secretario Municipal de Tributa\u00e7\u00e3o e Planejamento do da Prefeitura Municipal de Pedro Velho.<\/p>\n<p><strong>DA AVALIA\u00c7\u00c3O DAS CONSTRU\u00c7\u00d5ES<\/strong><\/p>\n<p><strong>Art. 14 <\/strong>&#8211; O valor venal das edifica\u00e7\u00f5es ser\u00e1 obtido atrav\u00e9s do produto de sua \u00e1rea constru\u00edda total pelo valor unit\u00e1rio da constru\u00e7\u00e3o, aplicando-se, ainda, o Coeficiente de Obsolesc\u00eancia (Co) e os fatores de corre\u00e7\u00e3o constantes das Tabelas XVII a XXIV, anexas neste decreto.<\/p>\n<p><strong>Par\u00e1grafo \u00fanico <\/strong>\u2013 O Coeficiente de Obsolesc\u00eancia (Co) ser\u00e1 determinado em fun\u00e7\u00e3o da Idade de Constru\u00e7\u00e3o ou de Cadastro (Ic), conforme equa\u00e7\u00e3o abaixo:<\/p>\n<p>Co = (1 \u2013 (0,8 \u00d7 (1- ((50 \u2013 Ic)\/50))))<\/p>\n<p><strong>Art. 15 <\/strong>\u2013 O im\u00f3vel constru\u00eddo que abrigue mais de uma unidade aut\u00f4noma, segundo o registro imobili\u00e1rio, ter\u00e1 tantos lan\u00e7amentos quanto forem essas unidades, rateando-se o valor venal do terreno pelo processo da fra\u00e7\u00e3o ideal conforme NB-140 da ABNT &#8211; Associa\u00e7\u00e3o Brasileira de Normas T\u00e9cnicas.<\/p>\n<p><strong>Art. 16 <\/strong>\u2013 O im\u00f3vel constru\u00eddo que abrigue mais de uma edifica\u00e7\u00e3o ter\u00e1 por valor venal o resultado do produto de sua \u00e1rea constru\u00edda total pelo valor unit\u00e1rio do padr\u00e3o predominante da constru\u00e7\u00e3o, obtendo um \u00fanico lan\u00e7amento.<\/p>\n<p><strong>Art. 17 <\/strong>\u2013 A \u00e1rea constru\u00edda total (bruta) ser\u00e1 obtida atrav\u00e9s da medi\u00e7\u00e3o dos contornos externos das paredes ou pilares, computadas as superf\u00edcies denominadas depend\u00eancias em geral e \u201cterra\u00e7os\u201d, cobertos ou descobertos, de cada pavimento.<\/p>\n<p><strong>Par\u00e1grafo \u00fanico <\/strong>\u2013 As piscinas, e quaisquer outras benfeitorias que possam agregar valor ao im\u00f3vel, ser\u00e3o consideradas como \u00e1rea constru\u00edda e ser\u00e3o incorporadas na \u00e1rea da constru\u00e7\u00e3o principal do im\u00f3vel.<\/p>\n<p><strong>Art. 18 <\/strong>\u2013 O valor unit\u00e1rio de constru\u00e7\u00e3o, de que trata o art. 14, ser\u00e1 obtido pelo enquadramento das edifica\u00e7\u00f5es em um dos tipos de constru\u00e7\u00e3o constantes da Tabela III, anexa a este Decreto.<\/p>\n<ul>\n<li><strong>1\u00ba <\/strong>\u2013 Para a determina\u00e7\u00e3o do tipo de constru\u00e7\u00e3o ser\u00e1 considerada a destina\u00e7\u00e3o original, independente de sua utiliza\u00e7\u00e3o atual.<\/li>\n<li><strong>2\u00ba <\/strong>\u2013 O padr\u00e3o da constru\u00e7\u00e3o ser\u00e1 obtido em fun\u00e7\u00e3o das caracter\u00edsticas construtivas e de acabamento predominantes existentes no im\u00f3vel, conforme Tabelas XVII a XXIV, anexas a este decreto.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>DAS DISPOSI\u00c7\u00d5ES GERAIS<\/strong><\/p>\n<p><strong>Art. 19 <\/strong>\u2013 Nos casos singulares de im\u00f3veis para os quais a aplica\u00e7\u00e3o dos procedimentos previstos neste decreto possa conduzir \u00e0 tributa\u00e7\u00e3o manifestadamente injusta ou inadequada, dever\u00e1 o Secret\u00e1rio Municipal de Tributa\u00e7\u00e3o e Planejamento, rever os valores venais, adotando ou n\u00e3o, novos \u00edndices de corre\u00e7\u00e3o, de of\u00edcio ou a requerimento do interessado, com a obrigatoriedade de apresenta\u00e7\u00e3o pelo contribuinte de laudo de avalia\u00e7\u00e3o com os elementos comparativos perfeitamente identificados e fotografados conforme a ficha de avalia\u00e7\u00e3o constante do valor venal do im\u00f3vel, elaborado por profissional habilitado.<\/p>\n<p><strong>Par\u00e1grafo \u00danico <\/strong>\u2013 Fica dispensado, a crit\u00e9rio da autoridade administrativa, da apresenta\u00e7\u00e3o do laudo de avalia\u00e7\u00e3o, previsto no caput deste artigo, o contribuinte que comprovar a impossibilidade de arcar com este \u00f4nus, levando-se em conta sua capacidade contributiva.<\/p>\n<p><strong>Art. 20 <\/strong>\u2013 Prevalecer\u00e1 sobre os crit\u00e9rios da avalia\u00e7\u00e3o o valor venal comprovado de determinado im\u00f3vel.<\/p>\n<p><strong>Art. 21 <\/strong>\u2013 N\u00e3o sendo publicados novos valores de valor venal de im\u00f3veis at\u00e9 o final de cada exerc\u00edcio, os valores ser\u00e3o reajustados com base no IPCA (\u00cdndice de Pre\u00e7os ao Consumidor Amplo) acumulado nos 12 (doze) meses anteriores.<\/p>\n<p><strong>Art. 22 <\/strong>\u2013 Os valores venais ser\u00e3o atribu\u00eddos aos im\u00f3veis para o dia 1\u00ba de janeiro do exerc\u00edcio a que se referir o lan\u00e7amento.<\/p>\n<p><strong>Art. 23 <\/strong>\u2013 Os casos omissos, bem como as instru\u00e7\u00f5es complementares necess\u00e1rias, ser\u00e3o objetos de ato da Secretaria Municipal de Tributa\u00e7\u00e3o e Planejamento.<\/p>\n<p><strong>Art. 24 <\/strong>\u2013 Este decreto entrar\u00e1 em vigor na data de sua publica\u00e7\u00e3o, revogadas as disposi\u00e7\u00f5es em contr\u00e1rio.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Pal\u00e1cio Joaquim da Luz, Pedro Velho\/RN, 30 de julho de
